Money bills all the way!
Parliamentary debates are an integral part of a parliamentary democracy. The practice of enforcing changes through converting bills into money bills for fear of their rejection not only dilutes the importance of debates but is also contrary to government accountability. The Finance Bill 2017 passed by the Lok Sabha had many additions to the original bill presented at the time of the budget. Some of these raise concerns about transparency and accountability. The present government has affected many legislative changes through finance bills, like introduction of inflation target mandate for RBI, mergers of appellate tribunals etc. A money bill significantly reduces the role of the Rajya Sabha to influence it. Examination of the legal boundaries of a money bill is under the consideration of the SC. Meanwhile, the decision to replace tribunals, which have an important role in improving accountability of regulators, should have been debated in the parliament. The issue of providing anonymity to companies in political funding also needed sufficient debate and deliberations. Pushing through important changes without Rajya Sabha approval undermines democracy. It is also against the spirit of provisions of the Constitution. We have seen such type of government actions in the past in our legislative history, for which the society and the economy has paid a heavy price. From this perspective as well, more debate and transparency are essential to keep our democracy alive.

सिर्फ और सिर्फ धन विधेयक ही!
संसदीय बहस संसदीय लोकतंत्र का महत्वपूर्ण अंग है। विधेयकों के पारित नहीं हो पाने के भय से विधेयकों को धन विधेयकों में परिवर्तित करके परिवर्तन अधिरोपित करना न केवल बहसों के महत्त्व को कम करता है बल्कि यह सरकार की जवाबदेही के भी विरुद्ध है।
लोक सभा द्वारा पारित वित्त विधेयक 2017 में बजट प्रस्तुत करते समय प्रस्तुत किये गए मूल विधेयक में अनेक नए प्रस्ताव जोड़े गए।
इनमें से कुछ प्रस्ताव पारदर्शिता और जवाबदेही पर चिंताएं उपस्थित करने वाले हैं। वर्तमान सरकार ने अनेक विधायी परिवर्तन धन विधेयकों के माध्यम से प्रवर्तित किये हैं, जैसे आरबीआई के लिए मुद्रास्फीति लक्ष्य की अनिवार्यता की शुरुआत, अपीलीय न्यायाधिकरणों का विलय इत्यादि।
धन विधेयक प्रभावी ढंग से राज्यसभा की इसे प्रभावित करने की भूमिका को पूरी तरह से कम कर देता है। धन विधेयक की न्यायिक सीमाओं का परीक्षण सर्वोच्च न्यायालय के विचाराधीन है। उसी समय, न्यायाधिकरणों के प्रतिस्थापन, जिनकी नियामकों की जवाबदेही में सुधार की दृष्टि से महत्वपूर्ण भूमिका होती है, पर संसद में बहस होनी चाहिए थी।
राजनीतिक निधीयन में कंपनियों को अनामता प्रदान करने के मुद्दे पर भी संसद में व्यापक बहस और विचारों का आदान-प्रदान होना आवश्यक था। राज्यसभा की अनुमति के बिना महत्वपूर्ण परिवर्तन करना लोकतंत्र को कमजोर करता है। साथ ही यह संविधान की मूल भावना के भी विरुद्ध है।
हमारे विधायी इतिहास में पूर्व में भी हमनें इस प्रकार की सरकारी कार्यवाहियां देखी हैं, जिनकी समाज और अर्थव्यवस्था ने भारी कीमत चुकाई है। इस दृष्टि से भी हमारे लोकतंत्र को जीवित रखने के लिए अधिक बहस और पारदर्शिता की आवश्यकता है।
