Patriarchal societies churning
The law ensuring 33% reservation for women in ULBs was enacted by Nagaland govt. in 2006, but could not be implemented for more than 10 years. The matter has been in courts. Urban Local Bodies (ULBs) are constitutional bodies and not traditional institutions. Similarly, the tribal bodies are not traditional institutions recognised by Article 371(A). The state government, which had enacted the above law, through a resolution rejected women’s reservation in ULBs. Finally, after the SC ruling the govt. announced local body elections in January 2017. Ever since the announcement tribal bodies have been protesting and even threatening women candidates. The state govt. has been a silent spectator and failed to assert the rule of law. The question is, are we still living in a primitive society? What about women’s rights? Can anyone upstage the legal norms so easily? The state govt. has even decided to write to the Centre demanding exclusion of Nagaland from Part IX A of the Constitution. Can this be called a responsible govt.?

शहरी स्थानीय निकायों में महिलाओं को 33 प्रतिशत आरक्षण का कानून नागालैंड सरकार द्वारा वर्ष 2006 में पारित किया गया था, परंतु पिछले 10 वर्षों के दौरान इसे क्रियान्वित नहीं किया जा सका है। यह मामला लंबे समय तक अदालत में था।
शहरी स्थानीय निकाय संवैधानिक निकाय हैं न कि पारंपरिक संस्थाएं। उसी प्रकार, जनजातीय निकाय भी संविधान के अनुच्छेद 371 (ए) द्वारा मान्यताप्राप्त पारंपरिक संस्थाएं नहीं हैं। राज्य सरकार ने, जिसने यह कानून अधिनियमित किया था, एक प्रस्ताव के माध्यम से शहरी स्थानीय निकायों में महिला आरक्षण को अस्वीकार कर दिया।
अंततः सर्वोच्च न्यायालय के निर्णय के बाद सरकार ने जनवरी 2017 में स्थानीय निकाय चुनावों की घोषणा की।
इस घोषणा के बाद से ही जनजातीय निकाय विरोध प्रदर्शन करते रहे हैं और यहाँ तक कि महिला प्रत्याशियों को धमकाते भी रहे हैं।
इस संपूर्ण स्थिति के दौरान राज्य सरकार मूक दर्शक बनी रही और कानून का पालन करवा पाने में असफल रही।
अब प्रश्न यह है कि क्या हम अभी भी आदिम युग में जी रहे हैं? महिला अधिकारों का क्या? क्या कानूनी प्रावधानों को कोई भी इतनी आसानी से उलट सकता है?
आश्चर्यजनक बात यह है कि राज्य सरकार ने केंद्र सरकार से नागालैंड को संविधान के खंड 9 ए से बाहर रखने की मांग करने का निर्णय लिया है। क्या इसे एक जिम्मेदार सरकार कहा जा सकता है?
